    1. Welcome to airinspect.store (the 'Website'). The Website provides for online courses, products and/or services (the 'Services').
    2. The Website is operated and owned by JC & VN Group PTY. LTD. (ABN 24 640 178 972) and comprises of the following entities: Air Inspect Australia and 6 Keys Aerial. Access to and use of the Website, or any of its associated Products or Services, is provided by Air Inspect Australia. Please read these terms and conditions (the 'Terms') carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of Services, immediately.
    3. Air Inspect Australia reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Air Inspect Australia updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records.
  2. Acceptance of the Terms
    1. You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by Air Inspect Australia in the user interface. These Terms apply to all users of the Website, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
    2. By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority in your state of residence and have given us your consent to allow any of your minor dependents to use this Website.
  3. Site content, ownership and use restrictions
    1. The material on the Website is protected by copyright under the laws of Australia and other countries through international treaties. Unless otherwise indicated and except for information directly from or links to third-party websites, all rights (including copyright) in all content, other material and compilations contained in, or used to create or support this site including text, graphics, logos, button icons, video images, audio clips and navigational and other software (collectively referred to as the Contents) are owned or controlled and are reserved by Air Inspect Australia.

You are not authorised, without the prior written permission of Air Inspect Australia and any other owner of rights in content that you access via the Website, to reproduce, frame, download, store (in any medium), communicate, show or play in public, adapt, change, or create a derivative work from that content. No trademark (whether registered or otherwise) that is contained on this site or otherwise used by Air Inspect Australia may be used without our prior, specific, written permission or that of the trademark owner.
    3. All intellectual property rights, including all content and materials on the Website, are retained by Air Inspect Australia. Any unlawful use or modification of the content and materials of the Website will be found to violate the intellectual property rights of the Air Inspect Australia. You may not sell, modify, reproduce, repost or convert any contents and/or materials on the Website in any manner inconsistent with these Terms.

Historical information, necessarily, is not current and is provided for your reference only. we reserve the right to modify the contents of this Website at anytime, but we have no obligation to update any information on our Website.
  4. Accuracy and Completeness of Billing and Account Information
    1. All information provided to Air Inspect Australia, must be complete, accurate and current information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. By continuing the use of this Website you agree to comply with any additional copyright notices, information, or restrictions contained in any keywords or other material available on or accessed through the Site.
    2. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
    3. We will send you emails from time to time where you have to option to opt out from. By providing your email address you automatically be added to our email mailing list for ongoing sales and educational communication.
  5. Fees and Payment
    1. All prices are inclusive of GST unless otherwise specified. Prices displayed on the Website are current at the time of issue, but may change at any time and are subject to availability. Prices and availability of items are subject to change without notice. Where permitted, we reserve the right to limit sales.
    2. Where the option is given to you, you may make payment for the Services (the 'Services Fee') by way of:
      • Credit Card Payment ('Credit Card')
      • Zip Pay ('Zip Pay')
      • AfterPay (‘AfterPay’)
      • Paypal (‘Paypal’)
      • Google Pay (‘Google Pay’)
      • Apple Pay (‘Apple Pay’)
    1. You agree and acknowledge that Air Inspect Australia can vary the Services Fee at any time.
    2. All payments made in the course of your use of the Services made by credit card payment, in using the Website, the Services or when making any payment in relation to your use of the Services, you warrant that you have read, understood and agree to be bound by the Stripe terms and conditions which are available on their website.


5. You acknowledge and agree that where a request for the payment of the Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Services Fee.

6. In any event, any payments that become overdue may be collected through debt collection services, at the expense of You. Further, overdue payments will attract interest at a rate in line with the current local court interest rate accruing from the day that the payment becomes due, until full payment is received by the supplier.

7. In the event that any payment becomes overdue Air Inspect Australia may immediately cease providing services to you until such date as payment is made. For the avoidance of any doubt, Air Inspect Australia will not be liable for any loss or damage you may suffer due to the fact that we were exercising our right under this clause.

8. Further, you agree to indemnify and keep indemnified Air Inspect Australia against all costs and disbursements, including legal costs, incurred by the Supplier as a result of any defaults on payment.

9. All prices are in the Australian Dollar.


6. Pricing and modifications to Services

1. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Services (or any part or content thereof) without notice at any time.

2. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Services.

7. Third Party links

1. Certain content, products and services available via our Services may include materials from third parties.

2. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

3. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Air Inspect Australia reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Services or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

Air Inspect Australia undertakes no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
9. Refund Policy
1. Air Inspect Australia places great importance on refunds, cancellations, and credit notes, and takes them seriously. For further terms and conditions on refunds, cancellations and credit vouchers, refer to Refund, Cancellations and Credit Vouchers policy, which can be found on the website.
10. Copyright and Intellectual Property

1. The Website, the Services and all of the related products of Air Inspect Australia are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Website (including but not limited to text, graphics, logos, button icons, video images, audio clips, Website, code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes, and are reserved by Air Inspect Australia or its contributors.

2. All trademarks, service marks and trade names are owned, registered and/or licensed by Air Inspect Australia, who grants to you a worldwide, non-exclusive, royalty-free, revocable license whilst you:

1. use the Website pursuant to the Terms;
2. copy and store the Website and the material contained in the Website in your device's cache memory; and
3. print pages from the Website for your own personal and non-commercial use.

Air Inspect Australia does not grant you any other rights whatsoever in relation to the Website or the Services. All other rights are expressly reserved by Air Inspect Australia.
3. Air Inspect Australia retains all rights, title and interest in and to the Website and all related Services. Nothing you do on or in relation to the Website will transfer any:
1. business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright, or
2. a right to use or exploit a business name, trading name, domain name, trade mark or industrial design, or
3. a thing, system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a thing, system or process),
to you.

4. You may not, without the prior written permission of Air Inspect Australia and the permission of any other relevant rights owners: broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Services or third party Services for any purpose, unless otherwise provided by these Terms. This prohibition does not extend to materials on the Website, which are freely available for re-use or are in the public domain.
11. Privacy
1. Air Inspect Australia takes your privacy seriously and any information provided through your use of the Website and/or Services are subject to Air Inspect Australia’s Privacy Policy, which is available on the Website.

12. General Disclaimer

1. Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.

2. Subject to this clause, and to the extent permitted by law:

1. all terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded; and

2. Air Inspect Australia will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms (including as a result of not being able to use the Services or the late supply of the Services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

3. Use of the Website and the Services is at your own risk. Everything on the Website and the Services is provided to you "as is" and "as available" without warranty or condition of any kind. None of the affiliates, directors, officers, employees, agents, contributors and licensors of Air Inspect Australia make any express or implied representation or warranty about the Services or any products or Services (including the products or Services of Air Inspect Australia) referred to on the Website, includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:

1. failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records;

2. the accuracy, suitability or currency of any information on the Website, the Services, or any of its Services related products (including third party material and advertisements on the Website);

3. costs incurred as a result of you using the Website, the Services or any of the products of 6 Keys Aerial; and

4. the Services or operation in respect to links which are provided for your convenience.

13. Limitation of Liability

1. Air Inspect Australia total liability arising out of or in connection with the Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Services to you.

2. Air Inspect Australia total liability to you (if any) in connection with the Website, or with these T&C’s or any goods or services supplied under them, will be limited to your discontinued use of the Website. To the maximum extent permitted by any applicable law, Air Inspect Australia and any other party (whether or not involved in the creation, maintenance, development or delivery of the Site) and the directors, officers, managers, employees, members, shareholders or agents of the Air Inspect Australia exclude all and any liability and responsibility for any amount or kind of loss or damage of whatsoever nature or kind that may result to you or a third party in connection with the Website in any way whatsoever or in connection with the use, inability to use or the results of use of the website, including without limitation actions or activities resulting from the use of resources presented on the Website, any websites linked to the Website or the material on such websites, including but not limited to loss or damage due to viruses that may affect your computer (including but not limited to computer equipment, software, data) or any other property on account of your use of or access to or browsing or downloading and/or uploading of any material of the Website or any website linked to the Website.

3. Further, Air Inspect Australia will not be held liable for server outages, including but not limited to software failure, hardware failure or internet connection failure. Air Inspect Australia will not be held responsible for any losses or damages that may occur due to these server outages.

4. Nothing in these Terms shall limit or exclude Air Inspect Australia liability in jurisdictions which do not allow the limitation or exclusion of liability for consequential or incidental damages. In such jurisdictions Air Inspect Australia liability shall be limited by the maximum extent permitted by law.

5. You expressly understand and agree that Air Inspect Australia, its affiliates, employees, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.

14. Headings

1. You agree that the headings used in these Terms are for convenience of reference only. Such headings will be and shall be ignored in the interpretation or construction of any of these Terms and Conditions.

15. Complete Understanding

1. You warrant and agree with Air Inspect Australia that these Terms and the Air Inspect Australia privacy policy, constitute the entire understanding between Air Inspect Australia and You with respect to your use of the Website, including, but not limited to, all orders placed through the Website.

16. Termination of Contract

1. The Terms will continue to apply until terminated by either you or by Air Inspect Australia as set out below.

2. If you want to terminate the Terms, you may do so by:

1. not renewing the Subscription prior to the end of the Subscription Period;

2. providing Air Inspect Australia with 14 days' notice of your intention to terminate; and

3. closing your accounts for all of the services which you use, where Air Inspect Australia has made this option available to you.

3. Air Inspect Australia may at any time, terminate the Terms with you if:

1. you do not renew the Subscription at the end of the Subscription Period;

2. you have breached any provision of the Terms or intend to breach any provision;

3. Air Inspect Australia is required to do so by law; the provision of the Services to you by Air Inspect Australia is, in the opinion of Air Inspect Australia, no longer commercially viable.

4. Subject to local applicable laws, Air Inspect Australia reserves the right to discontinue or cancel your membership at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts Air Inspect Australia’s name or reputation or violates the rights of those of another party.

5. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

17. Indemnity

1. You agree to indemnify Air Inspect Australia, its affiliates, employees, agents, contributors, third party content providers and licensors from and against:

1. all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with your Content;

2. any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so; and/or

3. any breach of the Terms.

18. Dispute Resolution

1. Compulsory: If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).

2. Notice: A party to the Terms claiming a dispute ('Dispute') has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.

3. Resolution: On receipt of that notice ('Notice') by that other party, the parties to the Terms ('Parties') must:

1. Within 14 days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree;

2. If for any reason whatsoever, 14 days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by the President of the Australian Mediation Association or his or her nominee;

3. The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a pre-condition to the mediation commencing. The Parties must each pay their own costs associated with the mediation;

4. The mediation will be held in a venue by mutual agreement in Australia.

4. Confidential: All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.

5. Termination of Mediation: If 30 days have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.

6. Venue and Jurisdiction: The Services offered by Air Inspect Australia is intended to be viewed by residents of Australia. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Victoria, Australia.

19. Governing Law

1. The Terms are governed by the laws of Victoria, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of Victoria, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.

20. Independent Legal Advice

1. Both parties confirm and declare that the provisions of the Terms are fair and reasonable and both parties having taken the opportunity to obtain independent legal advice and declare the Terms are not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.

21. Severance
1. If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force, such determination shall not affect the validity and enforceability of any other remaining provisions.
